§ 30.03 PROCEDURE FOR FILLING VACANCIES ON THE TOWN COUNCIL.

(A) Purpose. From time to time vacancies occur during the term of a Town Council Member that require the Town Council pursuant to Cal. Gov’t Code § 36512(b) to fill the vacancy either by appointment or special election. There is no opportunity to both provisionally fill the vacancy by appointment and then hold a special election at a convenient general election date. Pursuant to Cal. Gov’t Code § 36512(c) if the Town Council adopts an ordinance providing that all such vacancies during the term of a Council Member shall be filled by special election, then the said Code allows for an interim appointment pending the special election, and provides more flexibility in setting election dates.

(B) Filling a vacancy. When a vacancy occurs in the elective office of Town Council Member, during the term thereof, the vacancy shall be filled by special election.

(1) The special election shall be called within 30 days of the occurrence of the vacancy.
